In order to provide greater transparency surrounding the financial relationships of healthcare professionals and healthcare product, the US Physician Payments Sunshine Act (Open Payments) requires manufacturers participating in US federal healthcare programs to report certain payments and “transfer of value” (TOV) given to physicians. In addition, global guidance on transparency, including TOV, is evolving quite quickly. One area of particular challenge for manufacturers is support for scientific publications. With no clear guidance in the CMS Rules for Implementation, the interpretation of potential TOV associated with publication support currently varies by company and location. As TOV concerning scientific publications remain subject to further clarity, manufacturers must recognize the importance of educating external authors and other stakeholders on company-specific policies.
