Many consumers rely on food labels to provide them with an accurate representation of the nutritional content and benefits of the foods and beverages they purchase. Food and beverage manufacturers have recently experienced a surge in lawsuits relating to misleading label claims, particularly in instances where products are labeled as “all natural”, “natural”, “healthy”, or “nutritious”. While food manufacturers are responsible for the claims they make on their products, the lack of definitive FDA guidance on concerns such as the level of scientific support required for structure or function claims and what constitutes a “natural” or “nutritious” product, leaves both consumers and food producers stymied.
